Nothing I Can Do

Well…  There’s nothing I can do really…  The are long excerpts, not the whole thing – the excerpt, plus the link, means it basically sucks, and there’s basically nothing I can do.

I am going to be taking some steps for prevention of this in the future, however.  And yes that could mean partial feeds.  I’ve already gotten feedback that I will not be read due to that.

I’ve decided that if I go that route, and I’m not read because people want don’t want to click over?  That’s ok.  Sucks, but ok.  I need to do whatever I’m comfortable with.  I’m not sure what that looks like yet – but the only thing I’m selling here on my blog is me.

    The idea that there is nothing you can do is not technically true. There is plenty that you can do, even in this circumstance.

    The fact that they are attributing your work does not necessarily mean anything. If you look at the four factors for determining whether a use is “fair” under the fair use doctrine, you’ll find that attribution is not even weighed. The most important factors are the damage done to the market of the original work and whether the use was transformative. The blog, without seeing it, would seem likely to fail those tests.

    Even your CC license doesn’t give them permission to do what they are doing. The requirements of using a CC license much higher than what most scrapers can do. Did they list your license in the parts they scraped? They’re supposed to? Is the use non-commercial? It has to be.

    If you want to get your work removed, you can file either a spam report with the host or use a DMCA notice if the site is hosted in the U.S. (similar laws exist in the EU, Australia and most other major Internet nations).

    If you want to go the DMCA route, you can use the stock letters on my site.
